Dermatology and Laser Center of Charleston Agreed to Pay $426,000 for Allegedly Violating the Civil Monetary Penalties Law by Submitting Claims for Incident-to Services Not Provided as Claimed

After it self-disclosed conduct to OIG, Dermatology and Laser Center of Charleston, P.A. (DLCC), South Carolina, agreed to pay $426,744.91 for allegedly violating the Civil Monetary Penalties Law. OIG alleged that DLCC billed the services of physician’s assistants (PAs) at the physician rate when the services did not qualify for such rates under Medicare’s “incident to” billing requirements. The PAs rate, correctly billed, was 85% of the physician’s rate.
