Ebenezer Quainoo, MD and Baltimore Healthcare Agreed to Pay $255,000 for Allegedly Violating the Civil Monetary Penalties Law by Submitting Claims for Non-FDA Approved Drugs

On October 10, 2024, Ebenezer Quainoo, M.D. and Baltimore Healthcare P.C. (collectively, “Dr. Quainoo”), Maryland, entered into a $255,284.58 settlement agreement with OIG. The settlement agreement resolves allegations that Dr. Quainoo submitted false claims with procedure codes J7321, 76882, and 20610 for the administration of Hyalgan to Medicare beneficiaries when the Hyalgan was not approved by the United States Food and Drug Administration (FDA). OIG further alleged that Dr. Quainoo purchased the non-FDA approved Hyalgan from distributors that were not registered with the FDA. OIG’s Office of Investigations and Office of Counsel to the Inspector General, represented by Senior Counsel Jonathan Culpepper, collaborated to achieve this resolution.
