Kevin Michael Brown Agreed to Be Excluded for Five Years for Allegedly Submitting False Claims for Neuro-Stimulators

On July 10, 2024, in connection with the resolution of his False Claims Act liability, Kevin Michael Brown (Brown), Hemet, California, agreed to be excluded under 42 U.S.C. 1320a-7(b)(7) for five years. The investigation revealed and OIG alleged that Brown, through Revive Medical LLC and Revive Medical of San Diego, Inc. (collectively, “Revive”), submitted or caused false claims to be submitted to Medicare using HCPCS Code L8679, which is designed for “implantable neurostimulator, pulse generator” devices that a surgeon implants into a patient typically in an operating room, when patients did not undergo surgery and did not have a neurostimulator implanted into their bodies. OIG further alleged that the physician listed as the rendering and/or referring provider on the Medicare claims at no time rendered, referred, supervised, or reviewed any medical procedures, including those billed under L8679 that were performed at Revive.
